NBA Stock Exchange Game Official Rules. EligibilityNBA Stock Exchange Game ("Game") is open to legal residents (natural persons only) of the 50 United States, the District of Columbia, and Canada (excluding residents of Quebec) who are 13 years of age or older as of October 1, 2009 ("Participants"). Residents of Maine must be 18 years of age or older to participate in this Game. Eligible minors must obtain their parent's or legal guardian's consent prior to participation. Officers, directors, employees and agents of Turner Digital Basketball Services, Inc. ("Sponsor"), NBA Media Ventures, LLC, NBA Properties, Inc., the NBA and its member teams (the "NBA Entities"), and each of their respective parent companies, subsidiaries, affiliates, governors, owners, distributors, retailers, franchisees, advertising/promotion agencies and Project Support Team, Inc. ("P/S/T") (collectively "Released Parties") and the immediate family members (parent, spouse, sibling or child, regardless of where they reside) and those living in the same household of each, whether or not related, are not eligible to participate or win a prize. Game is subject to all applicable federal, state, provincial, and local laws. Promotion Period (Full Season)Registration for the Game will begin at 3:00:00PM Eastern Time ("ET") on October 1, 2009 and continue through the end of the Promotion Period (as defined below). The Game will begin at 3:00:00 PM ET on October 27, 2009 and end prior to the final buzzer of the last game on or about April 14, 2010, which end date is subject to change dependent upon the NBA schedule (the "Promotion Period"). The Game and participation in the Game are subject to these Official Rules. All entries become the property of Sponsor and will not be acknowledged or returned. The Game includes all NBA games of the 2009-2010 regular season, from the tip-off of the first regular season game on October 27, 2009 to the final buzzer of the last regular season game on April 14, 2010. This Game consists of five (5) entry periods listed in the chart below (each, an "Entry Period"). Promotion Period (Half Season)Registration for the Game will begin at 3:00:00PM Eastern Time ("ET") on February 16, 2010 and continue through the end of the Promotion Period (as defined below). The Game will begin at 7:00:00 PM ET on February 16, 2010 and end prior to the final buzzer of the last game on or about April 14, 2010, which end date is subject to change dependent upon the NBA schedule (the "Promotion Period"). The Game and participation in the Game are subject to these Official Rules. All entries become the property of Sponsor and will not be acknowledged or returned. The Game includes all NBA games played in the second half of the 2009-2010 regular season, from the tip-off of the first regular season game on February 16, 2010 to the final buzzer of the last regular season game on April 14, 2010. This Game consists of one (1) entry period listed in the chart below.
To Participate(1) Visit www.NBA.com during the Promotion Period. You must register before participating in this Game. Registration is free, as is participation in this Game. To register, complete the User Registration form according to the instructions provided. As part of the registration process, you will be asked if you wish to receive promotional emails from the NBA. Consenting to receive promotional emails is optional, is not required for membership or participation in this Game and does not impact your chances of winning. Upon completion of the registration process, you may link to the Game Play page using your newly designated user name and password to participate in the Game. Entrants are responsible for ensuring that all contact information is up-to-date and accurate. The use of script, macro or any other device to automate or subvert the registration process is prohibited and all such registration form submissions are void. Registration form submissions will be accepted throughout the Promotion Period, in accordance with the terms of these Official Rules. (2) (2) Visit the Game Play page where you will be given a designated amount of fantasy dollars (to be determined by Sponsor) (these fantasy dollars have no monetary value) to build the best basketball team you can afford. Participants will have to option to draft nine (9) different players (one (1) of each of the following: PG/SG/G/SF/PF/F/FC/C/UTL). To assemble your team, follow the instructions provided. Throughout the Promotion Period, you will have the opportunity to sell your athletes and buy new ones on the trading floor. You will also have the opportunity to join various leagues. You may not buy a player if you do not have the appropriate amount of fantasy dollars. For complete details visit nbase.nba.com. (3) All lineups and trades must be accepted and acknowledged by the computer servers by the applicable deadline to be considered valid and eligible. Released Parties are not responsible for lost, late, garbled, misdirected, inaccurate, incomplete, delayed, stolen or undelivered entries, team selections, trades, points, fantasy dollars, sales or registration form submissions; any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with the Game or by any computer, network, technical, mechanical, electronic, human or other error that may occur in administration of the Game, the processing of entries, team selections, trades, sales or registration form submissions in the Game, the tabulation of points or fantasy dollars or the compilation of teams, or the selection of the winners; any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, satellite, cable, computer equipment, telephones, software, or hardware, failure of email on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Game; any error, omission, interruption, deletion, defect, delay in operation or transmission, or the theft, destruction or alteration of entries or other materials; typographical, printing or other errors in these Official Rules, in any Game-related advertisements or other materials or announcement of potential winners or the distribution of prizes; the cancellation, suspension, preemption or postponement of any NBA games or injuries or other unavailability of players; or other problems or errors of any kind relating to or in connection with the Game whether mechanical, human, electronic, network or otherwise. Fantasy dollars have no cash value and are not redeemable for cash or transferable and may only be used as specified in these Official Rules. Scoring SystemEach Participant's NBA Stock Exchange Points ("NSEP") for the Game are awarded based on how Participant's selected players play in real-life NBA basketball games during the Promotion Period. For scoring format (which is incorporated herein by reference), please visit nbase.nba.com Winner Selection/NotificationPotential winners will be determined on or about May 17, 2010. (1) Grand Prize will be available to be awarded to the Participant who accumulates the highest number NSEP, as determined by Sponsor in its sole discretion, for the entire Promotion Period.
For each Monthly Period (outlined above), one (1) Monthly Prize and five (5) Runner Up Prizes will be available to be awarded to the Participants who accumulate the highest number NSEP, as determined by Sponsor in its sole discretion, for a total of (5) Monthly Prizes and (25) Runner Up Prizes for the entire Promotion Period. (1) Half Season Prize will be available to be awarded to the Participant who accumulates the highest number NSEP during the Half Season Entry Period (outlined above), as determined by Sponsor in its sole discretion. You must register for the Half Season Game as outlined above in order for you NSEP to be recorded properly. Prizes(1) Grand Prize: 3-day/2-night trip for two to one 2010 NBA Western Conference Finals game consisting of round-trip coach air transportation from major airport nearest to winner's residence in the U.S. to the city of game location, standard double-occupancy hotel accommodations, ground transportation to/from the airport and the applicable hotel, two tickets to the game and the opportunity to have a behind the scenes television experience with the TNT crew at the game (Approximate Retail Value "ARV"=$3,500). Actual prize value will vary depending on winner's city of departure. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of the site of the designated game as determined by Sponsor, and to award no additional prize in lieu of air transportation. Travel and hotel arrangements determined by Sponsor in its sole discretion through an agent of Sponsor's choice. Trip must be taken on dates and times designated by Sponsor or prize will be forfeited in its entirety and, at Sponsor's discretion, may be awarded to an alternate winner. Winner and guest must travel together on the same itinerary, and any minor traveling companion must be accompanied by his/her parent or legal guardian. If required, winner and his/her guest must be able to obtain valid passports (that do not expire within six (6) months of time of travel) and all other required documentation prior to time of departure and are responsible for obtaining all such travel documents.. If any Grand Prize events are canceled or postponed for any reason, travel prize will be awarded less applicable prize-related activity(s) and Sponsor will substitute that activity(s) with an item(s)/activity(s) of equal or greater value as determined solely by Sponsor. Exact seat locations at game to be determined by Sponsor in its sole discretion. All prize details are at Sponsor's sole discretion. (5) Monthly Prizes/(1) Per Monthly Entry Period: Authentic jersey signed by a NBA Player designated by Sponsor (ARV=$150US/each). (25) Runner-Up Prizes/(5) Per Monthly Entry Period: $25 gift certificate to NBAStore.com (ARV=$25US/each). (1) Half Season Prize: NBA Basketball signed by a 2010 NBA All-Star weekend Participant (ARV=$99US/each). Total ARV of all prizes=$4,474. ARVs of all merchandise reflects unautographed merchandise. ARV of hand-signed merchandise subject to fluctuation based on the featured NBA player and current market value at time of prize award. NBA merchandise is not game used. All prize details are at Sponsor's sole discretion. MiscellaneousNo transfer, assignment, cash redemption, or substitution of prizes (or portion thereof) except by Sponsor who reserves the right to substitute a prize (or applicable portion thereof) of comparable or greater value (except as otherwise provided above), at its sole discretion. Prizes are awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. Federal, state, provincial, and local taxes, including income and withholding taxes, and all other costs and expenses associated with the acceptance and use of any prize not specified herein as being awarded are winners' sole responsibility. If an eligible minor is selected as a winner, prize will be awarded in the name of said minor's parent or legal guardian and such parent/legal guardian will be required to fulfill all requirements imposed on winners set forth herein. Each winner (and, if an eligible minor, his/her parent or legal guardian) may be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within five (5) days of date of issuance of notification. Non-compliance with any of the foregoing or with these Official Rules may result in disqualification and awarding of prize to the runner up, at Sponsor's sole discretion. If any prize notification letter or prize is returned as undeliverable, winner will be disqualified and, at Sponsor's discretion, a runner up may be notified. Grand Prize winner and his/her traveling companion and ticket prize winners and their guests agree to comply with all NBA and venue rules and regulations relating to the use of NBA game tickets and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such game. Failure to do so may result in forfeiture of tickets. Sponsor, in its sole discretion, reserves the right to: 1.) disqualify any person who tampers with the entry process (and void his/her points), the operation of NBA.com, or any other component of this Game, or who is otherwise in violation of these Official Rules and 2.) modify, suspend or terminate this Game (or any portion thereof) should virus, bugs, non-authorized human intervention or other causes, including but not limited to war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Game or if the season is cancelled for any reason and, in the event of termination, at its discretion, award prizes for the Monthly Period(s) at issue from among all eligible non-suspect entries received for the applicable Monthly Period(s) as of the event requiring such termination using the scoring procedures set forth at nbase.nba.com. The use of any automated entry device or any other devices or methods that impact the integrity of the Game or participation process is prohibited and all such entries or points received are void. By participating, each Participant (and, if minor, his/her parent or legal guardian) agree to be bound by these Official Rules and agree that: 1.) Sponsor, the NBA Entities, their designees and assigns may use (unless prohibited by law) such Participant's name, city/state of residence, photograph and/or likeness for advertising and/or trade purposes and/or for the purpose of posting his/her name and NSEP total on NBA.com or on any NBA telecast and/or for any other purpose in any media or format now or hereafter known throughout the world in perpetuity without further compensation, permission or notification and 2.) Released Parties shall have no liability and will be held harmless for any liability, loss, injury or damage, including, without limitation, personal injury to Participant or any other person or death or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of any prize or participation in this Game.
